Is Kratom Legal In North Carolina?

As of 2023, kratom is legal in the state of North Carolina. In 2016, there were efforts to ban kratom in North Carolina. However, these proposals did not pass.

House Bill 747

House Bill 747 was introduced in the North Carolina House of Representatives on April 15, 2015. The bill was initially sponsored in the House to regulate the sale of kratom products, specifically the compounds mitragynine, and 7-hydroxy mitragynine, to minors.

The bill passed the House and was then revised by the Senate Health Care Committee on June 15, 2016. Further revisions were made by the Senate Judiciary II Committee on June 23, 2016.

The final version of HB 747 which passed the Senate on June 24, 2016, placed restrictions on selling kratom products to individuals under 18 years old but did not ban sale or possession for adults. It classified the sale to minors as a Class 2 misdemeanor. The bill also directed the Legislative Research Commission to study the public health impacts of kratom use in North Carolina.

Section 1 of the bill regulating kratom sales to minors went into effect on December 1, 2016. The remainder of HB 747 became effective immediately upon passage in June 2016. Ultimately, this legislative effort kept kratom legal in North Carolina for adults while imposing fines and penalties for distributing it to individuals under 18 years old.
