Kratom Legality in Puerto Rico: The Current Kratom Status in the Island in 2026

Although Puerto Rico is a U.S. territory, it has its own government that oversees and passes regulations. For kratom’s legality in Puerto Rico, there isn’t any clear regulation set for kratom just yet, but so far, two bills have been passed, and one is still under early consideration. Kratom laws on the island could change over time. But for now, let’s review details about kratom and its current legal stance in Puerto Rico.

Is Kratom Legal in Puerto Rico?

As of January 2026, there’s still no official law for kratom, which means it is unregulated and legal. That means kratom users can bring the herb into the island or find a place to buy it when they arrive. However, how long this status of kratom will last is something no one can tell for now. Senator Ríos Santiago, a current member of the Senate of Puerto Rico, has proposed two bills in different years, proposing an Act for the regulation of kratom. If approved, the Act shall be known as the Puerto Rico Kratom Consumer Protection Act.

The Senate Bill 1078 of November 2, 2022

This was the first bill concerning kratom in Puerto Rico, introduced by Senator Ríos Santiago and referred to the Committee on Community Initiatives and Mental Health. The focus was to regulate kratom for quality and safety. Below are some of the highlights of the proposal:

  • To ensure kratom is not adulterated or synthesized to alter its natural alkaloids
  • To make sure all kratom products are properly labeled and provide clear directions of use.
  • There should be an age restriction for those under 21 years old
  • Kratom extracts must not contain residual solvent levels greater than what is permitted under USP 467.
  • And the level of 7-hydroxymitragynine in kratom product must not exceed 2% of the total alkaloid composition of the product.

Under the proposal violators of this Act would have been subject to a fine of $500 for the first offence and $1000 for second or repeated offenses.

However, this bill stalled and didn’t get final approval.

The Senate Bill 741 of September 24, 2025

Again, Senator Ríos Santiago  reintroduced S.B 741 in 2025 which was referred to the Health Committee. It was introduced on September 24th, and that’s all we know for now. It has to go through the Senate, the House, and then be signed into law by the Governor. The content is almost the same as the previous bill, but this time, any processor or merchant who violates this law would be subject to a stricter fine not exceeding $5000 or imprisonment not exceeding six months.

Since kratom is technically legal in Puerto Rico, there are places to buy the herb on the island. We list some of the best shops on the Island.

La Isla Vapor & Smoke Shop 1, Aguadilla

The shop was established in 2015 and is one of the top places to buy kratom on the West Coast of Puerto Rico. Customers praise that they have quality kratom and offer excellent service. It opens every day and closes by 7 PM.

Condado Market, San Juan

The shop is located in Condado in front of the lobby of the La Concha Hotel. Some kratom users have bought kratom from this shop and liked their selection and customer service. The staff are friendly and bilingual, which makes communication easy. It runs every day and closes late by 11 PM.

Note: Most local shops in Puerto Rico that were once known as the top suppliers of kratom products are today permanently or temporarily closed. This gives a lack of local selection to customers visiting the island.

Buying Kratom in Puerto Rico Vs. Bringing Your Own

While kratom users may find some good local suppliers on the island, bringing your own has some advantages. Since kratom can be hard to source locally in PR, those travellers might consider bringing some of their own supply.

Another thing is that kratom is expensive in Puerto Rico because of the high transportation cost and most local shops buy in smaller batches, thereby increasing the total price.. This makes ordering online from top vendors such as us more economical.

Lastly, because most of the suppliers in Puerto Rico are small, their selection is often limited compared to online vendors. It is way easier to find a verified and reputable seller online than travel to PR with limited buying options. In the end, any of the options may work fine for consumers depending on the situation they find themselves in.

Final Thoughts on Kratom in Puerto Rico: Anything May Happen in the Near Future

Kratom is currently not regulated in Puerto Rico, but there is a bill in the pipeline calling for its regulation. A regulatory bill is a positive thing for kratom in PR. If the Puerto Rico Kratom Consumer Protection Act is passed it would be a positive thing for the kratom market. It is important to keep updated on current laws and keep note that things can change quickly with kratom regulation in any country, state or territory.
